Do I need to be Hazmat Endorsed as a Carrier to haul this?
Pretty simple answer:
No. The Class 9 placard is not required to be displayed on a motor vehicle within the U.S. Read: Is the class 9 placard required?
However, if you are transporting a bulk packaging (read: Bulk Packaging for HazMat Explained!), you must display the identification number (2211) on all four sides of the vehicle. You MAY choose to display the identification number on the class 9 placard.
Since the Class 9 placard is not required to be displayed, you are not required to have the HazMat endorsement on your CDL. The HazMat endorsement is only required if you transport a quantity of HazMat that requires the display of placards.
However, if you transport any quantity of HazMat you must have HazMat Employee training to include a component on safe driving.

Thank you for the clarification. Basically I’m not Hazmat Endorsed. My drivers are not Hazmat certified. But because it’s a UN2211 Class 9. Then we can still haul it even though it’s over 2,000 LBS.

Yes. That is correct.
Placards are not required for Class 9 in the U.S. no matter the amount.
The HazMat endorsement on the CDL is only required if the vehicle transports a quantity of HazMat that requires placards.
However, HazMat Employee training is required for anyone involved in the transportation of a hazardous material – even Class 9.
An additional component of Driver Training should be added to HazMat Employee training.
Also, though terms such as “Hazmat Endorsed” or “Hazmat certified” are used in the industry, they don’t exist in the regulations. The regulations of the Federal Motor Carrier Safety Administration (FMCSA) refer simply to the HazMat Endorsement on the Commercial Driver’s License (CDL).
USDOT/PHMSA regulations at 49 CFR 173.29(c) for transport of empty packagings refer to a “contract carrier” but the Hazardous Materials Regulations (HMR) do not define this term. (Neither does it define “common carrier” or “private carrier”, other terms used in the same section of the regulations.) What then is a “contract carrier” as the term is used by USDOT/PHMSA?
The first place to look for the definition of a word or term used by the HMR is 171.8 – Definitions. But you won’t find any mention of “contract carrier” there.

Sometimes a term used only by a specific section of the HMR will be defined in that section. But no luck finding the definition of “contract carrier” in §173.29 either.
Perhaps it can be found in the regulations of the Federal Motor Carrier Safety Administration (a sister administration to PHMSA within the USDOT), since it is the one that regulates commercial motor vehicles? However, “Since January 1, 2007 FMCSA has been required by law not to distinguish between common and contract carriers, as they were previously defined.” Due to a loop-hole in the regulations this did not go into affect until January 17, 2017. Read about it on the FMCSA website.
An indication of what USDOT/PHMSA means by the term “contract carrier” can be found in this letter of interpretation from July 25, 2003 (02-0259):
The term “contract carrier” is used in the HMR in the same manner as in the former Interstate Commerce Act (“the Act, “now repealed) to mean a person who transports by motor vehicle, for compensation, passengers or property in commerce “under continuing contracts with one person or a limited number of persons either (a) for the furnishing of transportation services through the assignment of motor vehicles for a continuing period of time to the exclusive use of such person served or (b) for the furnishing of transportation services designed to meet the distinct need of each individual customer.”
And further…
A contract carrier provides “specialized service” to its customers…”
So, in my words, a contract carrier operates under a contract to provide specific transportation services – by motor vehicle over a public roadway – to a single person or limited number of persons.
The Alliance for Uniform Hazmat Transportation Procedures (aka: HazMat Alliance) is a group of four states — Michigan, Nevada, Oklahoma and West Virginia — that register and permit carriers and shippers of hazardous materials in a uniform manner, utilizing the same application forms and fee assessment calculations.
Though originally conceived of as a way to standardize regulatory requirements nationwide, the recent defection of Ohio leaves only four states remaining as members of the HM Alliance. The remaining states and the type of HazMat each regulates under the HM Alliance is identified below.
Hazardous waste only
Michigan
Oklahoma
All hazardous materials (including hazardous waste)
Nevada
West Virginia

If you wish to transport regulated hazardous materials in any of the listed states, you must select a base state and file a HM Alliance application. Follow the steps below to apply for an Alliance HM permit:
Determine your base state.
If you will be transporting hazardous waste in Michigan or Oklahoma, calculate total miles traveled in each of the four states (Michigan, Oklahoma, Nevada and West Virginia) for the last twelve months. Your new base state is the state with the highest number of miles traveled.
If you do not transport hazardous waste in Michigan or Oklahoma, but transport hazardous materials (including waste) in Nevada or West Virginia, calculate total miles traveled in Nevada and West Virginia for the last twelve months. Your new base state is the state with the highest number of miles traveled.
Register online at https://www.hazmatalliance.org. Make sure you indicate your base state in the appropriate section of the online application.

On October 2, 2015 I had the opportunity to speak for 50 minutes or so at the MRA Safety Conference in Moline, IL. I was tasked with summarizing the Hazardous Materials Regulations of the USDOT and the applicable regulations to be addressed in Driver Training. After it was all over I sat down, made a few minor adjustments and created a narrated presentation using Office Mix. All you have to do is sit back and watch!
